AI Content Terms
The following provisions apply to AI-generated content and automated publishing functionality provided through Collablly Digital Marketing Agent ("Collablly DMA").
1. What Coby Does
Collablly Digital Marketing Agent ("Collablly DMA") includes an artificial intelligence assistant, Coby, that drafts articles, social media posts, images, and campaign plans ("AI Content") from the topics, instructions, and business information you provide ("Your Inputs"). AI Content is generated automatically by third-party AI models and is not written or reviewed by Collablly.
2. AI Content May Contain Errors
AI Content may be inaccurate, incomplete, outdated, misleading, or inappropriate. It may contain factual errors, invented details, statistics, or references, or wording or images similar to existing third-party material. The same Inputs may produce different results. Collablly does not guarantee that any AI Content is accurate, original, suitable for your purposes, or compliant with any law or platform rule.
3. You Review and Approve What Is Published
You are solely responsible for reviewing, editing, and approving AI Content before it is published, and for all content published from your workspace. Collablly DMA requires approval before publishing by default. Content is published only when a member of your workspace approves it, or when your workspace has turned on automated publishing.
Once published, content is your content and is published under your name or your organization's name. You are the publisher of that content, not Collablly.
4. Automated Publishing
If your workspace turns on automated publishing, or turns off the requirement to approve content before it is published, you authorize Collablly DMA to generate and publish content to your connected accounts on your schedule without further review, and you accept full responsibility for that content as if you had approved each item yourself. You can turn automated publishing off, pause it, or require approval again at any time.
5. Your Inputs and Your Content
You are responsible for Your Inputs and confirm that you have the rights needed to provide them, including any text, trademarks, or images. You grant Collablly a limited license to process Your Inputs and AI Content, including by sending them to our AI service providers, solely to provide the Services to you.
As between you and Collablly, you own the content you publish, subject to the rights of third parties and the terms of our AI providers and the platforms you publish to.
6. Laws and Platform Rules
You are responsible for making sure that content published from your workspace complies with all applicable laws and regulations, including advertising, consumer protection, endorsement and disclosure, intellectual property, privacy, and any rules specific to your industry, and with the terms and community standards of Facebook, Instagram, LinkedIn, X, WordPress, and any other platform you publish to.
You must not use Collablly DMA to publish content that is unlawful, defamatory, deceptive, infringing, harassing, or otherwise harmful.
7. AI-Generated Images
Images created by Coby are generated by AI and may not be unique. They are illustrations, not photographs of real events, places, products, or people, and must not be presented as such. You are responsible for deciding whether an image is appropriate to publish.
8. Not Professional Advice
AI Content is provided for general marketing purposes only and is not legal, financial, medical, technical, or other professional advice.
9. Third-Party Platforms
Collablly does not control Facebook, Instagram, LinkedIn, X, WordPress, or other third-party platforms. We are not responsible for their availability, for changes to their features or rules, or for how they display, limit, or remove your content or accounts.
Publishing may be delayed or fail because of these platforms, and we do not guarantee that any post will be published or remain published.
10. Disclaimer of Warranties
AI Content and the AI and publishing features of the Services are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
11. Limitation of Liability
To the fullest extent permitted by law, Collablly will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, reputation, goodwill, or data, arising from AI Content or from content published from your workspace, even if we were advised of the possibility of such damages.
Collablly's total liability for any claim arising from AI Content or publishing will not exceed the amount you paid Collablly for the Services in the twelve (12) months before the claim arose.
12. Indemnification
You agree to defend, indemnify, and hold harmless Collablly and its officers, employees, and agents from any claims, damages, losses, and expenses, including reasonable attorneys' fees, arising from content published from your workspace, Your Inputs, your automated publishing settings, or your violation of these terms, applicable law, or any third-party platform's rules.
13. Reporting a Problem
If you believe content published through Collablly DMA is inaccurate, infringing, or harmful, delete it from the platform where it was published and contact us at info@collablly.com.
We may suspend automated publishing or access to the Services to prevent harm or misuse.
